Even though the employee might not work over forty hours for any particular location, the law requires that their collective weekly work hours are still subject to overtime pay if they work over forty hours total. This unlawful form of wage theft is called “horizontal employment” and is grounds for lawsuit under the FLSA. You can recover the wages owed to you, plus an equal amount in liquidated damages.
